Apparently, having an opinion in Massachusetts can cause your girlfriend to lose her guns and permits.

I do not agree with the blog's posts but I do NOT believe that opinions should constitute loss of rights.

Which is illegal.

It was not fiction, or satire, or comedy.

It was a threatening, terroristic remark.

Support the causes worth supporting.

Wow! There's nothing there but someone admitting that they have a hard time comprehending where the line might be between protected protest speech or satire and illegal threats. Funny how this person thinks a law degree is required to have a substantiated opinion on the subject and thinks that posters here should defer to that authority. Why don't those assholes ever defer to the authority of education and intellect when it comes to public policy? Then, it's all anti-intellectualism and unintentionally ironic pseudo-populist class resentment.

Being a moron, an asshole or bigot does not invalidate your Constitutional rights. Why? Because all those things are subjective and the ones making the judgements about what's stupid, prejudiced or assholery (? :blink: ) are the same folks that can take those rights away.

If you don't stand-up for everyone's rights, then they really aren't RIGHTS anymore. Rights are meant to protect not only from the tyranny of authority, but also tyranny of the majority.

The guy in question is a douche bag of the highest order, but there are no asterisks in the Constitution with a footnote at the bottom saying " * Except douche bags...screw those guys, verily."

He said “one down 534 to go” after Giffords got shot. Is that insensitive? Yes. Is it in bad taste? Yes. Would his being punched in the dick repeatedly put a smile on my face? Yes (verily). But he can still say it.

I don't see the "declaration of intent" necessary to constitute a threat. What if he was making 534 voodoo dolls in his basement (probably made from used Kleenex and poor life choices)? Is that illegal? What if he decided to send all 534 legislators 200 lbs of bacon with the intent of the saturated fat killing them prematurely? I actually had this thought about Justice Scalia.

If he didn't own guns, would he still be allowed to say what he said? What if, instead of online, he said it at a bar after 6 cosmos?

Guys like Ted Nugget and Rush "Pillhead" Lamebot say crazy shit all the time and no one is taking their guns away (or their right to free speech). Why? Well, despite being as big a douche bag as this guy, anyone in authority to do such a thing knows that these particular douche bags have the resources to fight back. Also, these privileged douches live in places where the authorities actually agree with their douchebaggery.

Let's not make Constitutional rights a popularity contest, because I hate to break it too you all, as liberal gun owners, you ain't all that popular.

So far, there have been no criminal charges filed against Corcoran. But from what I can tell as of this writing, they're leaving him in limbo about the possibility of charges in the future. He has also had his property seized and his Second Amendment rights suspended. The post quoted above was either a criminal threat, or it was protected speech. If it was protected speech, you can't take Corcoran's property and revoke his gun rights as punishment for writing something that was rude, but not illegal. I actually think Nugent shouldn't be allowed to own guns. Being so crazy you get a draft deferment is just as good as being committed in my book.

In truth, what "one down" said was funny, in any sense of political humor. I mean..he could have played it a bit bigger, and for more laughs -- even if it was heartfelt. Now that was epic, but the words were homicidal, if taken with a literal intent. And no one Left or Right or Center seemed to think it was anything but funny.
