Too many rounds fired in Texas Popeyes DGU, per perp's mother

Looks like she's gearing up for the lawsuit.
Mother of dead Popeyes robber: ‘Why did he shoot him five times'
Ruiz said she understands the man who shot her son was defending his family, but she asked, “Why shoot him four more times? Why did he shoot him five times?”

Herrera’s mother said she wants to see surveillance video, to see what happened.

Police on Thursday would not say whether any video exists.

If he was shooting a revolver, that may have been all he had. You shoot till the threat is removed. A human with a gun in hand is a threat until dead or disarmed.
Freedom is never more than one generation away from extinction. It must be fought for, protected, and handed on or one day we will spend our sunset years telling our children what it was once like in the United States where men were free.

As my Dad taught me. Never point a gun at someone unless you intend to use it and then make sure they are unable to do you any harm.

Also always assume that anybody pointing a gun at you is going to do the same thing.

My sympathies to that mother whose son died. I know she is in great pain.
On the other hand, her son played a stupid violent game, and won a stupid violent prize.

Just a grieving mother full of regret probably feeling guilty she didn't question her son more closely, it was too late to start parenting him.. He was 19, an adult. If he was bipolar and schizophrenic, he chose to stop taking his medications. A risky path like he wanted to die. She'd have an uphill battle with a lawsuit if she even found a lawyer to take it.

Texas PC 9.31. Self-Defense...

Except as provided in Subsection (b), a person is justified in using force against another when and to the degree the actor reasonably believes the force is immediately necessary to protect the actor against the other's use or attempted use of unlawful force.  The actor's belief that the force was immediately necessary as described by this subsection is presumed to be reasonable if the actor:

(C) was committing or attempting to commit aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery;

83.001. Civil Immunity...

A defendant who uses force or deadly force that is justified under Chapter 9, Penal Code, is immune from civil liability for personal injury or death that results from the defendant’s use of force or deadly force, as applicable.

As has been noted, it appears that she will have great difficulty suing the father attempting to protect his family.
