The Supreme Court might be willing to take on a case challenging that. In Harper v Virginia Board of Elections they struck down state poll taxes and unconstitutional because "a state violates the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution whenever it makes the affluence of the voter or payment of any fee an electoral standard. Voter qualifications have no relation to wealth." An excessive tax on ammunition would be seen as making "wealth" a requirement to exercise the 2nd amendment right.

If this New York carry/permit case plays out the way I hope, the Supreme Court won't have to touch this since courts would be required to follow strict scrutiny review for 2A cases where this would fail, as it should. In fact, the request for cert for the New York outlines several cases that have been lost specifically on gun taxes due to watered down review to point out that courts aren't reviewing 2A cases as directed in Heller/McDonald. Gilchrest and Haskell Propose Tax on Ammunition
The bill, introduced by State Senator Will Haskell (D-26) and State Representative Jillian Gilchrest (D-18), would tax ammo at 50 percent of its cost in Connecticut.

"This is a public health crisis," said Gilchrest in a release. "Connecticut ranks 5th in the country for having the lowest rate of gun deaths because we have been a leader on bold public policy. But, even one preventable death is too many. We must continue to take the lead in order to eliminate gun violence."

If implemented, the bill would exclude ammunition sales to law enforcement and military.

Public health crisis, huh? So.... someone is in a murderous rage, and wants to kill a bunch of people. They go to the store to buy a 20 dollar box of ammo. When presented with a 10 dollar tax on top of the cost of the ammo, they suddenly say....

Once upon a time in the US, a bunch of do-gooder types decided alcohol was immoral and bad for everybody, so they made a law. Made a lot of criminals rich, made crime organize for efficiency and profit. Worked really well, especially when you have enough money to buy politicians and cops.

Worked well with drugs also.

Smugglers and other criminals really love laws that restrict anything the US citizen wants.

I don't think tobacco is in the same class as ammo, even for the ATF.

I assume that ammo taxes and restrictions are going to be the new frontier.

Democrats propose 35% ammunition tax
“Guns do cause gun violence, so we are asking for those who purchase ammunition to pay a little bit extra,” she said, adding that the intent of the bill is to exclude law enforcement officers, corrections staff, and military personnel using ammunition for their occupations.

House Majority Leader Matthew Ritter, D-Hartford, compared the excise tax to those already in place, such as those on alcohol and tobacco, which are charged on products sold legally but still pose a risk to society.
“When I hear groups like the NRA say that this proposal punishes law-abiding gun owners, I say shame on you,” Gilchrest said. “Those being punished are the victims of gun violence, from Hartford to Newtown.”

Gun owners, group of moms speak out at ammunition tax public hearing
"It is a creative mechanism to funding the creative work that community gun violence organization are doing to keep our communities safe," said Susan Vogel, Moms Demand Action for Fun Sense in America Connecticut Chapter.

A recent proposal called for a 35 percent tax on ammo.
Ammunition is subject to the sales tax and an 11 percent federal excise tax. No other state imposes its own excise tax on ammunition.

:sarcasm: Don't you know the sole cause of violence are guns. They emit evil vibrations that warp peoples minds. As they can't be outlawed , we have to work around the edges. Any talk of root causes is blaming the victim.
Unfortunately, this is the message I get from most (if not all) "progressive" politicians. Where are the people who want to attack climate change, reform immigration, etc. Is it possible to have a rational give and take conversation about firearms? :sad:
