New York AG sues Turnip's Charity for persistent illegal Conduct

#1 Post by TrueTexan » Thu Jun 14, 2018 4:33 pm

The noose is starting to tighten.

Seems Donny's Charity is not following the laws at least According to the New York AG.
NEW YORK, June 14 (Reuters) - New York’s attorney general sued U.S. President Donald Trump, three of his children and his namesake foundation on Thursday, alleging “persistently illegal conduct” at the nonprofit, including support for Trump’s 2016 presidential campaign.

Barbara Underwood, the attorney general, asked a New York state judge to dissolve the Donald J. Trump Foundation, and impose bans on Trump, his sons Donald Jr. and Eric, and his daughter Ivanka from holding leadership roles in New York charities.

Underwood said her office’s 21-month investigation, begun under her predecessor Eric Schneiderman, uncovered “extensive unlawful political coordination” by the foundation with Trump’s campaign, as well as “repeated and willful self-dealing” to benefit Trump’s personal, business and political interests.

Among the transactions the lawsuit cited as illegal was a $10,000 payment to the Unicorn Children’s Foundation for a portrait of Trump purchased at a fundraising auction in 2014, and $100,000 paid to another charity to settle a legal claim in 2007.

“Mr. Trump ran the Foundation according to his whim, rather than the law,” the suit said.
The Republican president attacked the lawsuit in a series of posts on Twitter that blamed Democratic politicians in his home state.

“The sleazy New York Democrats, and their now disgraced (and run out of town) A.G. Eric Schneiderman, are doing everything they can to sue me on a foundation that took in $18,800,000 and gave out to charity more money than it took in, $19,200,000,” Trump wrote. “I won’t settle this case!”
The Trump Foundation issued a statement criticizing the lawsuit as “politics at its very worst” and accusing the attorney general of holding its $1.7 million in remaining funds “hostage for political gain.”

The lawsuit adds to legal problems affecting Trump, including a probe by Special Counsel Robert Mueller into whether Trump’s 2016 campaign colluded with Russia. Trump has denied there was any collusion, and Russia has denied meddling in the election.

The lawsuit filed in the state Supreme Court in Manhattan is seeking $2.8 million of restitution plus penalties, a 10-year ban on Trump serving as a director of a New York nonprofit, and one-year bans for his children.

“As our investigation reveals, the Trump Foundation was little more than a checkbook for payments from Mr. Trump or his businesses to nonprofits, regardless of their purpose of legality,” Underwood said in a statement. “That is not how private foundations should function.”

The 41-page complaint details a myriad of alleged wrongdoings, including the improper use of charity funds “to influence his election for president.”

Trump is also accused of using the charity’s funds to pay his business expenses. In one instance in 2007, he allegedly took $100,000 from the Trump Foundation to settle a lawsuit with the town of Palm Beach, Florida, after his Mar-a-Lago resort was found to be in violation of several ordinances regarding flagpoles.

A handwritten note obtained by prosecutors shows Trump directing his accounting staff to use the money to pay off the settlement.

“Staff followed Mr. Trump’s instruction to use the Foundation’s account to satisfy the settlement obligation, even though the Foundation was not involved in the lawsuit in any way,” the complaint reads.

Poor Donny doesn't have his fixer anymore, to make these nasty old things go away. Rudy is not the fixer that Cohen was. Rudy can screw up a steel ball bearing with a rubber mallet.

As usual the NY State Atty Gen does the work that the US Atty Gen should be doing. Barbara Underwood was appointed by Cuomo and she's said she won't be running in November so she's not worried about political fallout. But expect the Liar in Chief to attack Underwood even a low blow attack on her weight.

Gold Standard: When Trump furiously tweets about a law suit against him--he's guilty as hell!

This is probably not just a civil action but is probably criminal.

More on how the “Charity” was run.
Former U.S. Attorney Preet Bharara broke down the corruption of President Donald Trump’s charity scandal during an interview with CNN’s Wolf Blitzer on Thursday.

New York Attorney General Barbara Underwood filed a suite against the Trump Foundation claiming that the company was used in a way to pay off President Trump’s creditors. The Trump Foundation is run by his children Ivanka and Eric Trump.

Bharara said Underwood had no political motive in bringing the case against President Trump and his children.

“Underwood, is not a political person. She is not even running for attorney general in the fall. She has the respect of people on all sides of the political spectrum,” he said.

Bharara said mass evidence supporting the foundation’s corruption led to the lawsuit. Bharara claimed the organization hasn’t even had an official meeting in over 19-years.

“The board of directors never met, and hasn’t met in I think 19 years, since 1999. It was a foundation that over, and over again backed up by specific pieces of evidence, by e-mail and documents, and by very credible, concrete allegations was used as a funnel to pay off legal debt, to various charities, or to further his political campaign,” he said. ” It’s clear as black and white, it’s not supposed to engage in politics.”

Bharara continued: “There are allegations after allegations that this foundation was basically a front for Donald Trump, and his business interests to do what they pleased. It’s not a large foundation given that Donald Trump is a billionaire, yet you see the foundation didn’t have any employees. It didn’t have any oversight. It was governed on a whim.”

Also Ivanka and Eric Trump could be exposes them to Federal Campaign Finance charges.
New York state attorney, General Barbara Underwood sued President Donald Trump and his children, Ivanka and Eric Trump on Thursday.

Ivanka and Eric Trump serve as directors of the Trump Foundation. The lawsuit states that there was: “extensive and persistent violations of state and federal law,” and Underwood is “seeking restitution of $2.8 million plus penalties.”

Frank Figliuzzi, former Assistant Director for Counterintelligence, told MSNBC’s Nicolle Wallace that Trump’s family corruption must be a “genetic trait.”

“It’s widespread corruption. It’s a genetic trait apparently. This is going to be tough for him because it touches directly on Ivanka and Eric with their roles in the charity,” Figliuzzi said. “It’s a reminder to Trump that you may have federal issues. You can fire Mueller, you can fire Rosenstein, but there are state attorneys generals out there that you still have to deal with. You are not above the law.”
