Background:
Existing law outlines the procedures for agencies to follow in the collection, maintenance, and dissemination of personal information, as defined, in order to protect the privacy of individuals. Existing law generally prohibits an agency from disclosing any personal information in a manner that would link the information disclosed to the individual to whom it pertains. Existing law permits the disclosure of that information to the University of California or a nonprofit educational institution, under specified conditions.

Existing law establishes a center for research into firearm-related violence, administered by the University of California, to research with a mission to provide the scientific evidence on which sound firearm violence prevention policies can be based, as specified. Existing law allows for the collection of various data relating to crimes and firearms, including, among other things, criminal history information, a database of gun violence restraining orders, and a database of firearm precursor parts purchases. Existing law makes the unauthorized furnishing of criminal history information a crime. Existing law, as amended by the Safety for All Act of 2016, an initiative statute approved by voters as Proposition 63 at the November 8, 2016, statewide general election, created a database of ammunition purchases and made that database confidential. Proposition 63 allows its provisions to be amended by a vote of 55% of the Legislature so long as the amendments are consistent with, and further the intent of, the act.
Here is the new part:
This bill would name the center for research into firearm-related violence the California Firearm Violence Research Center at UC Davis. The bill would generally require that the information above be made available to the center and researchers affiliated with the center, and, at the department’s discretion, to any other nonprofit bona fide research institution accredited by the United States Department of Education or the Council for Higher Education Accreditation, as specified, for the study of the prevention of violence. The bill would require that material identifying individuals only be provided for research or statistical activities, and require that information to only be used for those purposes and would prohibit reports or publications derived from that information from identifying specific individuals. By providing access to criminal history information, the unauthorized furnishing of which is a crime, this bill would expand a crime and create a state-mandated local program. The bill would additionally require the Department of Justice to establish procedures for these requests, as specified.

Totally agree, gun owners are third class citizens in CA and Newsom will probably sign that bill. Are they going to share it next with anti-gun groups who produce questionable data?

That is exactly what I was thinking when I first read the new legal language. Let's say Texas Republicans did this for voting or abortion research, and named one of their pet "research centers" in the bill.

Exactly, Democrats play both sides of the issue. They'll plead victimhood when a Republican plays their own game. Newsom was doling out state stimulus money while he was running to defeat his recall, a Republican would have been hung, drawn and quartered by Democrats saying that was buying votes if they had done the same. In their eyes we're second class citizens supporting a second class amendment.

The director of the UC, Davis Center has his own agenda.
“Upward trends in firearm purchasing, violence and political extremism are converging to put the USA at risk for disaster in the months ahead,” Garen Wintemute warned in introducing the report. “We have no time to waste if we are to prevent the loss of thousands of lives and emerge with our democracy intact.”

Those are strong and alarming words, particularly from an academic researcher.
Wintemute, 69, is director of the California Firearms Violence Research Center at UC Davis. He has been studying gun violence for nearly 40 years, and his research has provided the impetus for several major gun control bills in the state Legislature. He’s also an emergency room physician whose obsession with firearms violence grew from his constant treatment of gunshot wounds.

But does that also make him a sociologist?
Dan Schnur, a onetime Republican strategist who is a political science professor at USC and UC Berkeley, said: “As long as we convince each other that people who disagree with us are evil, the likelihood for violence will keep growing. The answer isn’t more gun control or more gun ownership…. The core issue is tolerance.”

There is amongst us, apparently. And so, let it start here.

That's a big reason why I attend gun shows and talk with our White Conservative brothers and sisters, BTW. I remind them that the political leaders and their media allies are doing everything they can to keep us divided and conquered. I have found that we're really not so different when you get down to it, and that's the approach that I take. So far, it's worked out very well every time I've done that.

3. As a condition on the exercise of Plaintiffs’ fundamental right to keep
and bear arms under the Second Amendment of the United States Constitution,
Plaintiffs and millions of other law-abiding California residents provided the Cal
DOJ with highly sensitive personal information—including their name, address,
place of birth, telephone number, occupation, California driver’s license or ID
number, race, sex, height, weight, hair color, eye color, and, in some instances,
social security number (the “Personal Information”)—which the Attorney General
and Cal DOJ maintain in a registry called the “Automated Firearms System” (the
“AFS”).

4. The United States Constitution, the California Constitution, and
California statutory law protect Plaintiffs’ right to privacy in the Personal
Information that they provided to the Cal DOJ as a condition to Plaintiffs’ lawful
exercise of their Second Amendment rights in the first instance. Plaintiffs disclosed
their Personal Information in reliance on the government’s assurance that their
information would be used only for law enforcement purposes.

5. On September 23, 2021, the California Legislature passed, and
Governor Newsom signed into law, AB 173, as a budget trailer bill. AB 173
amends certain provisions of California’s firearm laws to authorize the Attorney
General to disclose Plaintiffs’ Personal Information to the California Firearm
Violence Research Center at UC Davis and any other “bona fide research
institution.” Those amendments violate and infringe on the rights of Plaintiffs and
millions of other law-abiding citizens under the federal and state constitutions, and
state statutes.

Glad they filed it in the Southern District, the other three US districts in CA aren't that firearms friendly. Information leaks from university research facilities, they tend to use a lot of students - free or cheap labor. I doubt wealthy and powerful people in CA want their personal information and firearms ownership known. An Irvine, CA based law firm not Michel and Associates.
